Under India’s Digital Personal Data Protection Act, 2023 (“DPDP Act”), we act as a “Data Fiduciary” for the personal data we process.
Laws we follow
We handle personal data in line with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, the Information Technology Act, 2000 and its rules, and the record-keeping requirements of Indian tax, customs, and foreign trade laws.
Many of our buyers are outside India. Where a foreign law applies to you, such as the EU or UK General Data Protection Regulation (GDPR), we will respect the rights that law gives you, as explained in the section “Visitors and buyers outside India”.
What personal data we collect
Data you give us through enquiry, contact, and “Request a Quote” forms: your name, company name, designation, email address, phone or WhatsApp number, country, city, destination port, and the details of your requirement, such as product, variety, quantity, packaging, and preferred Incoterm.
Data you give us when you place an order or sign a contract: billing and shipping addresses, the names and contact details of your consignee and notify party, your company registration and tax identifiers, import licence or permit numbers where needed for shipping documents, and bank details needed for payments or letters of credit.
Data from suppliers, mills, and manufacturers: contact persons’ names, phone numbers, email addresses, and business registration details.
Data from your conversations with us: emails, WhatsApp messages, call notes, sample requests, and feedback.
Data collected automatically when you visit the website: IP address, browser type, device information, pages visited, referring website, and date and time of visit. This is collected through server logs and cookies.
We do not ask for sensitive data such as health information, biometric data, or religious beliefs, and we ask you not to send it to us.
How we use your data
We use your data to reply to your enquiries, prepare quotations and proforma invoices, and send product specifications and samples.
We use your data to carry out contracts and orders. This includes sourcing, quality inspection, packaging, fumigation, booking freight, and preparing export documents such as commercial invoices, packing lists, certificates of origin, phytosanitary certificates, and bills of lading.
We use your data to process payments, letters of credit, and bank remittances.
We use your data to meet our legal duties. This includes customs filings, GST and tax records, APEDA contract registration where required, and requests from government authorities.
We use your data to send you order updates, shipment tracking, and after-sales support.
We use your data to keep our website secure, prevent fraud and spam, and understand how visitors use the site so we can improve it.
If you have agreed to receive them, we use your data to send you product updates, new crop or price information, and trade news. You can stop these at any time.
We do not sell or rent your personal data to anyone.
Our legal basis for using your data
We process your personal data with your consent, which you give when you submit a form, write to us, or ask us to contact you. You may withdraw your consent at any time. Withdrawing consent does not affect processing we carried out before you withdrew it.
We may also process data without separate consent where the DPDP Act allows it. This includes data you have voluntarily given us for a specific purpose, such as fulfilling an order you placed, as well as compliance with Indian law, court orders, or government requests, and medical emergencies or other situations the law recognises.
Contact forms and comments
When you submit an enquiry, contact, or quote form, we receive the information you enter and your IP address and browser details. The IP address and browser details help us detect spam. Forms may be checked by an automated spam detection service, which sees this information only to check for spam.
If our website allows public comments, anything you post in a comment, including your name, will be visible to the public. Please do not include personal or confidential business information in public comments.
WhatsApp, email, and phone
If you contact us on WhatsApp, your messages are handled under WhatsApp’s own privacy policy as well as this policy. We use WhatsApp only to reply to your enquiry and manage your order. We will not add you to broadcast lists unless you ask us to.
We currently use a Gmail account (dashakalp.traders@gmail.com) for business email. Emails sent to this address are stored on Google’s servers and are also subject to Google’s privacy policy. Business emails and call notes are kept as described in “How long we keep your data”.
Media
If you send us images, such as product samples, labels, or packaging artwork, we use them only for your order. If any images are uploaded to the public website, please make sure they do not contain embedded location data (EXIF GPS), because visitors can download images and extract that data.
Cookies
Cookies are small text files stored in your browser. We use them to make the website work and to understand how it is used.
Essential cookies keep the website secure and working properly, for example by remembering your session or protecting forms from spam. These cookies do not need your consent.
Analytics cookies, if we use them, collect anonymised information about how visitors use our pages, such as the pages viewed and time spent. We use them only with your consent where the law requires it.
Our website runs on WordPress. If you visit the login page, a temporary cookie checks whether your browser accepts cookies. This cookie contains no personal data and is removed when you close your browser. Login cookies are used only by our website administrators.
You can block or delete cookies in your browser settings. Some parts of the website may not work properly if you do.
Embedded content and links to other websites
Pages on this site may include embedded content such as videos, maps, or images. Embedded content from other websites behaves exactly as if you had visited that website. Those websites may collect data about you, use cookies, add their own tracking, and monitor how you interact with the embedded content.
Our website links to other websites, including our streetwear brand KHTM (khtm.in). Each website has its own privacy policy, and we are not responsible for how other websites handle your data.
Who we share your data with
We share personal data only where it is needed to serve you, run our business, or comply with the law. We share only the data the recipient needs.
Logistics and shipping partners: freight forwarders, customs brokers (CHAs), shipping lines, transporters, container freight stations, and courier companies, so they can move your goods and prepare shipping documents.
Inspection and certification bodies: quality inspection agencies, laboratories, fumigation agencies, and authorities that issue phytosanitary certificates and certificates of origin.
Banks and payment providers: our bankers and your bankers, for payments, remittances, and letters of credit.
Government and regulatory authorities: Indian Customs, DGFT, GST authorities, APEDA, FSSAI, export promotion councils, and authorities in the destination country, where filings or documents require it.
Our suppliers and manufacturers: limited order information, such as packaging or private-label details, so they can make and pack your products. We do not share your contact details with them unless needed.
Service providers who work for us: website hosting (Hostinger), email services (Google Gmail), cloud storage, and spam protection. They process data only for these services and must keep it secure.
Professional advisers: our chartered accountants, auditors, and legal advisers, where needed.
Law enforcement and courts: where required by law, court order, or a lawful government request.
If you request a password reset on our website, your IP address will be included in the reset email.
International data transfers
Because we are an export business, your data may be sent to or accessed in other countries. Examples include the destination country of your shipment, the countries of shipping lines and banks involved in the transaction, and the countries where our service providers store data.
We transfer data outside India only as the DPDP Act allows. We will not transfer data to any country the Government of India restricts. For transfers of data from the EU or UK, we use appropriate safeguards where GDPR requires them.
How long we keep your data
We keep personal data only for as long as needed for the purpose it was collected for, or for longer where the law requires it.
Enquiries that do not lead to an order: up to 3 years from our last contact, so we can follow up on repeat or seasonal requirements, unless you ask us to delete it sooner.
Order, invoice, shipping, and payment records: at least as long as Indian law requires. Under the GST law, books of account and records must be kept for 72 months from the due date of the annual return for the relevant year, and longer if there is any appeal, investigation, or legal proceeding. Customs, foreign trade, foreign exchange, and income tax laws may require similar or longer periods.
Marketing preferences: until you unsubscribe or withdraw consent.
Website logs and analytics data: up to [12–26] months.
Public comments (if any): until they are removed. Comment metadata may be kept so that follow-up comments can be recognised and approved automatically.
When data is no longer needed, we delete it or make it anonymous, unless the law requires us to keep it.
How we protect your data
We use reasonable security measures to protect personal data from unauthorised access, loss, misuse, or disclosure. These include SSL/HTTPS encryption on our website, access controls and passwords on our systems, limiting access to staff who need the data, regular backups, and contracts with service providers that require them to protect your data.
No system on the internet is completely secure. If a personal data breach occurs, we will inform the Data Protection Board of India and the people affected, as the DPDP Act and its Rules require.
What rights you have over your data
Under the DPDP Act, you have the right to access a summary of the personal data we hold about you and how we use it.
You have the right to ask us to correct, complete, or update inaccurate or incomplete data.
You have the right to ask us to erase your data when it is no longer needed. We will keep data that we are legally required to hold, such as invoice and export records.

You have the right to nominate another person to exercise your rights if you die or become incapable.
You have the right to raise a grievance with us. If you are not satisfied with our response, you can complain to the Data Protection Board of India.
To use any of these rights, email us at dashakalp.traders@gmail.com with the subject “Data Request”. We may need to confirm your identity before we act on your request.
